Privacy policy

01. Who we are

This website is operated by Breaker Industries Pty Ltd (ABN 29 667 485 305), a company registered in New South Wales, Australia ("Breaker", "we", "us"). Our Sydney office is at Cicada Innovations, Eveleigh NSW 2015, Australia. Our US team works through Breaker Corp, our wholly owned subsidiary in Austin, Texas, and this policy covers both.

We handle personal information in line with the Australian Privacy Principles in the Privacy Act 1988 (Cth). We have chosen to hold ourselves to them whether or not the Act applies to a given piece of information, and we extend the same standard to people outside Australia.

02. What we collect

We collect only what we need to answer you, to consider you for a role, or to keep the site running:

• Enquiries. The contact form asks for your first and last name, email address and phone number, and whatever you write in the message.
• Newsletter sign-ups. The form in the footer asks for your email address and nothing else.
• Job applications and expressions of interest. What you choose to send us, which is usually your name, contact details, CV, work history and anything you write in answer to our questions.
• Technical information. Like any website, ours receives your IP address, browser and device type, and the pages you asked for. Our host records these in standard server logs.

We do not ask for sensitive information, such as health, political or religious details, through this site. Please do not send it. If a role later needs a security clearance or background check, we will explain what that involves and ask for your consent before collecting anything.

You can read this site without telling us who you are. If you would rather not give your name when you contact us, say so; we will help where we can, though we may not be able to do everything without knowing who we are dealing with.

03. How we use it

We use personal information for the purpose you gave it to us, and for purposes directly related to that:

• to reply to an enquiry, and to follow it up if it turns into a conversation about working together,
• to send the company news you signed up for,
• to assess an application, arrange interviews, and make and manage an offer,
• to keep the site secure, including spotting and blocking spam and abuse.

We do not sell personal information, rent it or trade it. We do not use it for advertising, and we do not build profiles of visitors. No decision about you is made by software alone.

04. Who we share it with

We share personal information only with the service providers that run parts of the site and our hiring for us, and only as far as each one needs it:

• Netlify, which hosts this website and receives what you send through its forms.
• Google Workspace, where our email lives, so it holds any correspondence with you.
• Notion, which hosts our expression-of-interest form and our internal records.
• Ashby, our applicant tracking system, which holds applications for advertised roles.

Information may also pass between Breaker Industries Pty Ltd and Breaker Corp, for example when a US enquiry is answered from Austin. Beyond that, we disclose personal information only where the law requires it or where you have agreed.

05. Overseas disclosure

Breaker works from Australia and the United States, and each of the providers above stores data in the United States as well as elsewhere. Personal information you give us is therefore likely to be held or accessed in the United States, whichever country you are in.

We use providers that commit contractually to protect the information they hold for us, and we take reasonable steps to ensure they handle it consistently with the Australian Privacy Principles.

06. Keeping it secure

The site is served only over an encrypted connection, and what you send through a form travels the same way. Inside the company, access to personal information is limited to the people who need it for the purpose it was collected, on accounts protected by multi-factor authentication.

No system is perfectly secure. If a data breach involving your information is likely to cause you serious harm, we will tell you and the Office of the Australian Information Commissioner, as the Notifiable Data Breaches scheme sets out, and say what we are doing about it.

07. How long we keep it

We keep personal information only for as long as we need it, then delete it or strip it of anything that identifies you:

• Enquiries: two years from our last contact with you, unless they lead to a working relationship, in which case they become part of that record.
• Newsletter: until you unsubscribe. Every email carries a link to do so, and we remove you promptly.
• Applications: twelve months after the role closes, so we can contact you about a similar one. Tell us if you would like yours deleted sooner. If you join us, your application becomes part of your employee record.
• Server logs: kept by our host for a short period for security and troubleshooting, then discarded.

08. Your rights

You can ask us for a copy of the personal information we hold about you, and ask us to correct anything that is inaccurate, out of date or incomplete. You can also ask us to delete it, or to stop using it for a particular purpose, such as the newsletter.

Write to contact@breakerindustries.com. We will confirm who you are before acting, and respond within 30 days. There is no charge. If we cannot do what you ask, for example because the law requires us to keep a record, we will tell you why.

If you are in the European Union, the United Kingdom or a US state with its own privacy law, you may have further rights under that law, such as data portability. Ask and we will honour them.

09. Complaints

If you think we have mishandled your personal information, tell us first at contact@breakerindustries.com. We will acknowledge your complaint within five business days and aim to resolve it within 30.

If you are not satisfied with our answer, you can complain to the Office of the Australian Information Commissioner at oaic.gov.au, or to the privacy regulator where you live.

10. Children

This site is written for the defence and robotics industry and is not directed at children. We do not knowingly collect personal information from anyone under 16. If you believe a child has sent us something, tell us and we will delete it.

11. Cookies

This site sets no cookies of its own. It keeps three small settings in your browser, and it loads a YouTube player only if you press play on a video. Our cookie policy covers both in full.

12. Changes to this policy

We will update this policy when what we collect, or how we handle it, changes. The date at the top of the page shows when it last changed. If a change affects information we already hold about you, we will tell you before it takes effect.
