The terms on which you may use this website. They cover the site itself. Any product or service Breaker supplies is governed by a separate written agreement.
01. About these terms
This website is operated by Breaker Industries Pty Ltd (ABN 29 667 485 305) of Cicada Innovations, Eveleigh NSW 2015, Australia. "Breaker", "we" and "us" mean that company and its subsidiary Breaker Corp.
By using the site you accept these terms. If you do not accept them, please do not use it.
02. What this site is
This site describes who Breaker is and what we build. It is published for general information only.
Nothing on it is an offer, a warranty, or advice to act on without speaking to us. Descriptions of Avalon and our other work, including capabilities, specifications, integrations and availability, are a summary and may change without notice. Any supply of a product or service is governed by a separate written agreement, and that agreement prevails over anything on this site.
Some pages describe plans, programmes and future capabilities. Those statements reflect our intentions when they were written. They are not a promise that any of it will happen, or happen on a particular timeline.
03. Using the site
You may read the site, and share links to it. You must not:
- use it in a way that breaks the law or infringes anyone's rights,
- attempt to gain unauthorised access to it, or to any system or network connected to it,
- probe, scan or test its security without our written permission,
- interfere with its operation, or introduce anything malicious to it,
- scrape, mine or systematically copy its content, including to train a machine learning model, without our written permission.
If you have found a security issue in the site, please report it to contact@breakerindustries.com rather than testing further. We are grateful for responsible disclosure.
04. Do not send controlled information
Please do not send us classified information, export-controlled technical data or anything similarly restricted through this website, its forms or the email addresses it lists. They are not approved channels for that material.
If a conversation with us needs to cover it, say so in general terms and we will arrange an appropriate channel.
Nothing on this site is, or contains, technical data subject to export control.
05. Our content and trademarks
The content of this site, including its text, photographs, video, drawings, software and design, is owned by Breaker or used with permission, and is protected by copyright and other intellectual property law. Apart from reading it and sharing links, you may not reproduce, adapt or publish it without our written permission.
Journalists may quote the site and use images from our newsroom when reporting on Breaker, with credit. For anything else, or for high-resolution assets, write to media@breakerindustries.com.
Breaker, Avalon and the Breaker mark are our trademarks. Other names and logos on the site belong to their owners. Showing them describes work we have done or are doing with those organisations, and does not imply their endorsement unless we say so.
06. What you send us
When you send us something through the site, such as an enquiry, an application or a sign-up, you confirm that it is accurate and that you are entitled to send it. We handle any personal information in it as our privacy policy describes.
If you send us an idea, a suggestion or feedback without a separate agreement covering it, we may use it freely and owe you nothing for it. Please do not send confidential material unless we have agreed in writing to receive it.
07. Links to other sites
We link to other websites, including news coverage, our social profile and our hiring tools, for your convenience. We do not control those sites and are not responsible for their content or their handling of your information. Their own terms and policies apply once you arrive.
08. Availability
We aim to keep the site available and accurate, but we do not promise that it will be uninterrupted, error free or up to date at any given moment. We may change, suspend or withdraw any part of it at any time.
09. Liability
Nothing in these terms excludes, restricts or modifies any consumer guarantee, right or remedy you have under the Australian Consumer Law, or any other right that the law says cannot be excluded.
Subject to that, and to the extent the law allows, the site is provided as is. We exclude all warranties and conditions not expressly stated in these terms, and we are not liable for any loss or damage arising from your use of the site or your reliance on its content. That includes indirect or consequential loss, and loss of profit, revenue, data or opportunity.
Where our liability for a failure to comply with a consumer guarantee cannot be excluded but can be limited, it is limited to supplying the relevant service again.
10. Governing law
These terms are governed by the laws of New South Wales, Australia. You and we each submit to the non-exclusive jurisdiction of the courts of New South Wales and the courts that can hear appeals from them.
If any part of these terms is found to be unenforceable, the rest continues to apply.
11. Changes to these terms
We may update these terms. The date at the top of the page shows when they last changed, and the version published when you use the site is the one that applies.
